29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  A) Zehr's Metal & Flat Roofing LLC on or about January 26, 2018 at the address of 7973 Quarry Road, Maumee, OH : The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. 29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:   A) Zehr's Metal & Flat Roofing LLC on or about January 26, 2018 at the address of 7973 Quarry Road, Maumee, OH: The employer did not ensure an employee operating from the Nifty TD34T Aerial Lift utilized a personal fall arrest system that was adequately secured (clipped-off) to the lift's basket. Employees operating from this condition were exposed to falls greater than 10 ft.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   A) Zehr's Metal & Flat Roofing LLC on or about January 26, 2018 at the address of 7973 Quarry Road, Maumee, Ohio, 43537: The employer did not ensure employees were protected from falls while installing new roofing materials to a residential type structure.  The employees were exposed to a potential 10 foot fall to the level below.
