29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    On or about February 14, 2018, the employer required employees mixing chemicals in the Batch Area to wear 3M, N95 filtering facepiece half-mask respirators.  The employer did not develop and implement a written respiratory protection program to assist in preventing or eliminating physiological burdens and respiratory difficulties.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:     On or about February 14, 2018, the employer required employees mixing chemicals in the Batch Area to wear 3M, N95 filtering facepiece half-mask respirators.  The employer had not provided medical evaluations to employees prior to their use to determine the employee's ability to use a respirator.     Abatement certification is required for this item in accordance with the requirements of 29CFR 1903.19(c).

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:    On or about February 14, 2018, the employer required employees mixing chemicals in the Batch Area to wear 3M, N95 filtering facepiece half-mask respirators. The employee(s) wore facial hair interfering with the seal area of the respirator, which would limit the effectiveness of the respirator to prevent or eliminate exposure to chemicals.     Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
