29 CFR 1910.22(a)(3): Walking-working surfaces were not maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice:                    a) South side parking lot hazardous waste storage area - On or about February 11, 2020, forklifts were required to drive on grating that covers a trough to stock pallets of chemicals.  The grate was in poor condition creating a unstable surface for the forklift and foot traffic.  Employees were exposed trips and fall hazards, and the loss of control of material handling devices, including forklifts.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a. On or about March 11, 2020, in the warehouse, the employer failed to ensure that temporary employee(s) who operate powered industrial vehicles, were properly trained and evaluated by persons who have the knowledge, training and experience to train powered industrial truck operators and evaluate their competence to perform the tasks in a safe manner, thereby exposing employees to struck-by hazards.
