29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) Joao & Bradley Construction - Magnolia and Bloomfield Streets, Warminster Worksite - On or about February 27, 2018, an employee was dry cutting asphalt roadway with a walk-behind masonry saw (Table 1 Task). The employer did not properly implement the required engineering controls, work practices, or a respiratory protection as specified in table 1 and the employer did not assess exposure limits to silica in accordance with paragraph (d) of this section, exposing the employee to silica inhalation hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
