29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about 6 March 2018, and at times prior thereto, workers at the jobsite located at 605 E. University Avenue, Georgetown, TX, were performing construction activities without the use of hard hats, exposing the workers to the hazard of being struck by falling materials, tools, or debris.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person. On or about 6 March 2018, and at times prior thereto, workers were working from a scaffold platform that was elevated by a rough terrain telehandler forklift which was job-made and not designed by a qualified person, exposing the workers to the hazard of falling up to approximately 20 feet to the ground below. 1) Long Platform: This scaffold was used for various elevated job tasks on the outside of the building under construction. 2) Wooden Pallet Platform: This scaffold was used to apply Tyvek wrap onto the outside of the building under construction.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use. On or about 6 March 2018, and at times prior thereto, workers were elevated while on a platform by a Rough Terrain Telehandler Forklift that had not been approved for such use by the manufacturer, exposing the workers to a fall hazard of up to approximately 20 feet to the ground below.
