29 CFR 1926.451(c)(1)(ii): The employer did not ensure that scaffold guys, ties, and braces shall be installed where the scaffold height reaches 4 times the scaffold width (4:1 ht/width ratio) and repeated vertically every 26 feet vertically, (every 20 feet for scaffolds less than 3 ft wide). With such guys, tied, braces installed at each end of the scaffold and at horizontal intervals not to exceed 30 ft: a) On the 50 ft tall pipe scaffolds at front and back of the building; scaffold tie-in braces were removed leaving the scaffolds without sufficient bracing. Employees were exposed unstable scaffold/ scaffold collapse hazard. Location: 460 W 23rd Street, New York, N.Y. On or about 2/20/2018 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffolds structural integrity: a) The employer did not provide effective scaffold inspection of the 50 ft pipe scaffolds at front and back of the building. During masonry activities scaffold tie-in braces were removed without first installing temporary bracing, resulting that the scaffolds did not have sufficient bracing. Location: 460 W 23rd Street, New York, N.Y. On or about 2/20/2018 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
