29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  a) On or about 4/2/18 at a renovation project located at 5999 South Park Avenue, Hamburg, New York; an employee was preparing duct work from the roof by reaching through 40" x 40" hole. There was no fall protection in place.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 4/2/18 at a renovation project located at 5999 South Park Avenue, Hamburg, New York;  a 6- foot stepladder was left in the closed position while an employee utilized it to access the roof. The side rails did not extend 3 feet above the landing surface.  NO ABATEMENT CERTIFICATION REQUIRED
