29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Jobsite located at 15 Sprucewood Road, Villas, NJ:  On or about May 1, 2018 employees were utilizing hard hats while framing a single family home. An employee working at the site was fatality injured after being struck in the head with a wooden ledger.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The ladder was used in the folded position and was not fully opened with the locking mechanisms engaged,  on or about May 1, 2018.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  a) EPN Construction, jobsite located at 15 Sprucewood Road, Villas, NJ: On May 1, 2018 at approximately 2:33 pm an employee of EPN Construction was fatality injured while working on the framing of a single family home.  The death was reported on May 2, 2018, at approximately, 12:15pm, not within the required 8 hour reporting period.
