29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On or about June 7, 2018 at 2750 Ramada Way in Green Bay, employees were working from a Genie S-85 aerial lift basket at thirty-five feet above surface level without utilizing fall protection equipment.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about June 7, 2018 at 2750 Ramada Way in Green Bay,the employer did not ensure that the employee that was walking and working on a low sloped roof section of a commercial building and at a height of fourteen and one half feet above the lower level was provided fall protection. The GTO Stucco & Designs LLC dba GTO Stucco was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1219041, citation number 01, item number 04b and was affirmed as a final order on June 20, 2017, with respect to a workplace located at 1005 S. Moorland Rd.; Brookfield, WI 53005.

29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about June 7, 2018 at 2750 Ramada Way in Green Bay, the employer did not have a program to ensure a competent person was performing frequent and regular inspections that could have recognized and addressed fall from elevation hazards associated with employees working from an aerial lift basket without using personal fall arrest systems and working on a roof with an unprotected edge fourteen and one half feet above the surface level without utilizing fall protection equipment.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. On or about June 7, 2018 at 2750 Ramada Way in Green Bay, the employer did not provide written certification of employee fall protection safety training for employees who were working at heights greater than six feet and had been provided fall protection equipment.
