OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the fact that operator restraint systems (seat belts) provided, were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to effectively enforce the use of the operator restraint systems  during forklift operation.     a) Worksite: While CSHO was inspecting the TCM forklift used at the worksite it was discovered that both male and female seat belt ends were stuck below the operator's seat and metal cover for the batteries was clamped down shut over the belts pinning them in place. They had not been used by the operator.     ABATEMENT CERTIFICAITON IS REQUIRED
