OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing hazards as a result of being ejected from the rough terrain forklift:     (a)Marquardt/Skyway, Inc., at 30653 US Hwy 81, Yankton, SD 57078: On or about and at times prior to June 19, 2018, the employer did not ensure employees were utilizing seat belts while operating the Gehl Rough Terrain forklift. On May 27, 2018, a truck driver was severely injured when the rough terrain forklift he was operating fell off the side of a flat bed trailer during loading operations. The employee was ejected from the ROPS cab of the forklift and suffered a fractured leg. This condition exposed an employee to crushing injuries.         Abatement Note: Among other methods, one feasible and acceptable abatement method to control this hazard is to follow ANSI/ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks, paragraph 5.3.19 states, "An active operator protection device or system, when provided, shall be used. "Operator protection in the event of tip-over is intended to reduce the risk of entrapment of the head and torso between the truck and the ground but may not protect the operator from possible injury."

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    (a)Marquardt/Skyway, Inc. at 30653 US Hwy 81, Yankton, SD 57078: On or about and at times prior to June 19, 2018, the employer did not ensure employees successfully completed the required powered industrial truck training prior to being allowed to operate forklifts.  This condition exposed employees to the hazards associated with unsafe forklift operation to include struck-by, crushed-by and caught in-between hazards.    Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1904.39(a)(2): Employer failed to report, within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, employer did not report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    (a)Marquardt/Skyway, Inc. at 30653 US Hwy 81, Yankton, SD 57078:  On or about and at times prior to June 19, 2018, the employer did not report an in-patient hospitalization of an employee who was injured in the line of duty.  One employee was hospitalized with a fractured leg from an equipment loading accident in that, the employee was attempting to load a rough terrain forklift on a flatbed truck when the employee drove the forklift off the trailer. The employer failed to notify OSHA within 24 hours that an employee was injured and required in-patient hospitalization.
