29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person: a) At the jobsite, on the roof, on or about 6/20/18: A worker was on the section of roof in front of the garage (street side) garage with a 10:12 pitch, and a ground to eave height of 12 feet, using an anchorage with only one fastener visible from one side of the device.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a) At the jobsite, on the roof, on or about 6/20/18: A worker was on the main section of roof with an 8:12 pitch and a ground to eave height of 21 feet, where his anchor was located greater than 15 feet and at 90 degrees from where he was working; assuring that he would free fall greater than six feet, clear the roof edge, and assure a significant swing-fall.

Forte Brothers Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926 501(b)(13), which was contained in OSHA inspection number 1020574 , citation number 1, item number 2 and was affirmed as a final order on 4/8/15, with respect to a workplace located at #1 Talamore Development, Baldwinsville, NY.
