29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:       a.)    Formtech Enterprises, Inc., Extrusion line 1, on or about August 1st, 2018 and times prior thereto:  The employer did not institute a continuing and effective hearing conservation program when employees noise exposure exceeded an 8 hour time weighted average sound level of 85 dbA.  An employee performing plastic extrusion operations at Extrusion line 1 was exposed to noise levels of 73.48 % of the allowable limit during a 421 minute sampling period on August 1st, 2018.  Exposure calculation included a zero exposure increment for the 59 minutes not sampled.  This exposure is equivalent to a sound level of 87.7 dBA for the dose and time of employee exposure.

Formtech Enterprises, Inc., Extrusion line 1, on or about August 1st, 2018 and times prior thereto:  The employer had neither developed a noise monitoring program nor conducted noise monitoring for employees potentially exposed to an 8-hour TWA (Time Weighted Average) of 85 dbA.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:       a.)     Formtech Enterprises, Inc., Forklift battery charging station-warehouse, on or about July 13th, 2018 and times prior thereto:  Employees worked with and around corrosive chemicals including, but not limited to, sulfuric acid during maintenance checks and additions of water to electric forklift batteries.  Employees did not have immediate access within the work area to a suitable eyewash/shower station.
