29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    On July 25, 2018 located on the north east side of an exterior residential roof structure, an employee was exposed to a fall hazard while installing felt paper onto a steep residential roof structure not utilizing any fall protection system. Potential fall height was measured to be 17'-9" with a roof pitch of 10/12.    The Luis Lopez Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1247705, citation number 2, item number 1 and was affirmed as a final order on 10/23/2017, with respect to a workplace located at 6078 Magnolia Way, Cincinnati, OH 45247.    The Luis Lopez Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1216208, citation number 1, item number 1 and was affirmed as a final order on 4/25/2017, with respect to a workplace located at 9621 Conner Street, Harrison, OH 45030.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  On July 25, 2018, located on the north east side of a residential structure, the employer failed to install a fall protection system prior to an employee installing felt paper onto a steep residential roof structure. Potential fall height was measured to be 17'-9" feet with a roof pitch measured to be 10/12.  The Luis Lopez Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.502(a)(2), which was contained in OSHA inspection number 1247705 citation number 1, item number 2 and was affirmed as a final order on 10/23/2018, with respect to a workplace located 6078 Magnolia woods Way, Cincinnati, OH 45247.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
