29 CFR 1926.651(b)(3): When excavation operations approached the estimated location of underground installations, the exact location of the installations was not determined by safe and acceptable means:    Or in the alternative;    Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to electrical shock and/or electrocution hazards:    (a)   On June 4th, 2018 employees of Fox Underground, Inc. were exposed to a 15kv underground power line while installing storm sewer where the employer used the excavator, while within the tolerance zone of the utility, to mechanically determine where the line was located resulting in contact being made with the power line, located in the vicinity of Sheyenne Street & 17th Avenue West in West Fargo, North Dakota.     (b)   On June 14th, 2018 employees of Fox Underground, Inc. were exposed to a 15kv underground power line while installing storm sewer where the employer used the excavator, while within the tolerance zone of the utility, to dig directly over the line resulting in contact being made with the power line, located in the vicinity of Sheyenne Street & 14th Avenue West in West Fargo, North Dakota.
