This was most recently observed at 24th and Furnas St, Ashland, Nebraska on August 2, 2018 when an employee had been working in 2 excavations that were both 10' deep with vertical walls and there were no protective systems in place.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: The employer is failing to protect employees from a struck by hazard by not keeping excavated materials at least 2 feet from the edge of an excavation. This was most recently observed at 24th and Furnas St, Ashland, Nebraska on August 2, 2018 when the spoil pile was located at the edge of an excavation opening that had been occupied by an employee who was performing sewer pipe connecting work.
