29 CFR 1926.1052(b)(1): Foot traffic was not prohibited on stairways where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date and stairs were not temporarily fitted with wood or other solid material at least to the top edge of each pan.  Location: North River House, Port Liberte, Jersey City, NJ.  a) Employer permitted the use of a stairway that lacked filled material at a landing that was unguarded thereby exposing employees to tripping and fall hazards of up to 20 ft to the ground below; on or about 8/2/18.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Location: North River House, Port Liberte, Jersey City, NJ.  a) Employees at the construction site were exposed to fall hazards of up to 20 ft to the ground below when using a stairway that was missing sections of guardrail; on or about 8/2/18.  Back Dog Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(4)(i), which was contained in OSHA inspection number 978879, citation number 1, item number 1 and was affirmed as a final order on 7/10/14, with respect to a workplace located at 122 Christopher Columbus Drive, Jersey City, NJ.
