29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) 1369 Sheep Hill Road, Pottstown, PA 19465 - The employer did not ensure that a competent person conducted an inspection of a trench approximately 10 feet deep and 94 feet long.  Employees performed plumbing work in the trench, which had spoils piles kept at the edge of the trench and no cave-on protection, and were thus exposed to cave-in hazards.  This condition was noted on or about August 6, 2018.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) 1369 Sheep Hill Road, Pottstown, PA 19465 - The employer did not instruct employees who performed plumbing work in a trench, which was approximately 10 feet deep and 94 feet long and had spoils piles kept at the edge of the trench and no cave-on protection, in the recognition and avoidance of the unsafe conditions and the applicable regulations.  Employees were thus exposed to cave-in hazards.  This condition was noted on or about August 6, 2018.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) 1369 Sheep Hill Road, Pottstown, PA 19465 - The employees working in a trench approximately 10 feet deep and 94 feet long were not protected from struck-by and cave-in hazards in that the employer did not ensure spoils pile were at least 2 feet from the edge of the excavation. This condition was observed on or about August 6, 2018.
