Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.   On or about August 23, 2018, at the construction site located at Building #4, 2581 Walcutt Road, Hilliard, Ohio, employees were performing framing work on the second story floor level of a two story residential apartment building at approximately 10 feet in height with no fall protection, thereby exposing the employees to a fall hazard.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.   On or about August 23, 2018, at the construction site located at Building #4, 2581 Walcutt Road, Hilliard, Ohio, the employer failed to maintain a safety and health program to ensure hazard detection and correction.  Lagunas Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1324340, citation number 1, item number 2a and was affirmed as a final order on July 16, 2018, with respect to a workplace located at 10348 Sawmill Road, Powell, Ohio.
