29 CFR 1910.146(d)(2): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not identify and evaluate the hazards of permit spaces before employees entered:   a)  On August 10, 2018 the employer did not evaluate the recognized risks that manholes and other similar confined spaces may posed when environmental conditions are present such as but not limited to, organic material that may decay and produce hydrogen sulfide gas which may lead to severe health risks or death when concentrations reach IDLH (immediately dangerous to life and health) concentrations in the enclosed environments such as manholes or vaults.

29 CFR 1910.146(d)(3)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including specifying acceptable entry conditions:  (a)   On August 10, 2018 the employer did not provide employees with clear and consistent instructions that identified confined spaces, such as but not limited to those containing potentially hazardous atmospheres such as hydrogen sulfide gas, as requiring a permit for entry and the measures and procedures that must be recorded and adhered to eliminate and control safety entry into the space; nor adequate training with the means or methods to measure potentially lethal airborne concentrations of hydrogen sulfide that employees may inhale.
