The concrete platform had an unguarded open sided edge that was 65 inches above the work floor. Employees use the platform to service and maintain the utility piping and to access the vertical shaft section.

According to 29 CFR 1910.28(b)(3)(v)(A) the employer did not ensure the cover was closed or a removable guardrail system was provided on all exposed sides:    On or about October 18, 2018, employees were exposed to an open hatchway at the north hall utility shaft in the basement of the research facility. Employees service and maintain the steam, water and electrical utility lines in the shaft. The hatchway opening was approximately 30 inches by 24 inches wide and 4 feet above the lower level.
