29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged: A) On or about October 31, 2018, or times prior to, at the above referenced inspection site, employees used a forklift with a chain to lift the rear axle (back wheels) of a semi-truck off of the ground and push the vehicle, exposing the forklift operator to such hazards as, but not limited to, a tip over hazard. In The Alternative OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of having the forklift tip over while in operation. A) Facility, or about October 31, 2018, or times prior to, employees used a forklift with a chain to lift the rear axle (back wheels) of a semi-truck off of the ground and push the vehicle, exposing the forklift operator to a tip over hazard. Among other methods, one feasible and acceptable means of abatement would be to not allow employees to use the forklifts to move vehicles in this manner.
