29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)J & J Earthworks, Inc. at Barker Hill, Agency Village, SD 57262: On or about and at times prior to November 30, 2018, the employer did not ensure employees performing work in an excavation at depths greater than 5 feet were protected from cave-in hazards in that competent person inspection including soil evaluation was not performed on the day of the inspection prior to employees performing work in the excavation. This condition exposed one employee to cave-in hazards.

(a)J & J Earthworks, Inc. at Barker Hill, Agency Village, SD 57262: On or about and at times prior to November 30, 2018, the employer did not ensure employees performing work in an excavation at depths greater than 5 feet were protected from cave-in hazards by an appropriate protective system. This condition exposed employees to cave-in hazards.
