29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  A) Mejia Masonry, LLC on or about December 4, 2018 at the address of 3540 Secor Road, Toledo, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. Employees working near or around untrained forklift operators were exposed to struck-by hazards, while elevating scaffolding equipment during erecting and dismantling operations.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  A) Mejia Masonry, LLC on or about December 4, 2018 at the address of 3540 Secor Road, Toledo OH: The employer did not ensure employees were trained in scaffold erection and dismantling prior to the performance of these activities onsite. Employees erecting supported scaffolding systems without the benefit of training or the supervision of a competent person were exposed to hazards such as falls.
