29 CFR 1910.134(a)(2): A respirator shall be provided to each employee when such equipment is necessary to protect the health of such employee. The employer shall provide the respirators which are applicable and suitable for the purpose intended. Location: To include but not limited to pet area, bird seed area, shelving and displays containing food, slipper display, clothing/food backroom, store storage area and any other area containing vermin waste. On or about 1/11/19 the employer provided and required workers the use of single strap dust masks when cleaning up the vermin feces and nesting material. Dust masks will not protect against viruses such and hantavirus, Leptospirsis, Lymphocytic Chorio-meningitis.

29 CFR 1910.141(a)(3)(i): All places of employment shall be kept clean to the extent that the nature of the work allows. Location: To include but not limited to: pet area, bird seed area, shelving and displays containing food items, employee break room, slipper display, clothing/food backroom, store storage area. On or about 1/11/19 the building was not kept free of, vermin feces, urine and nesting material that was visible in employee work areas. Exposure to these can result in various illnesses such as, but not limited to hantavirus.

29 CFR 1910.141(a)(4)(ii): All sweepings, solid or liquid wastes, refuse, and garbage shall be removed in such a manner as to avoid creating a menace to health and as often as necessary or appropriate to maintain the place of employment in a sanitary condition. Location: To include but not limited to: pet area, bird seed area, shelves and displays containing food items, slipper section, carpet section, employee break room, clothing and food back room, large storage area. On or about 1/11/19 the waste from the vermin infestation was not being removed in a manner that avoided the creation of health risks or maintains sanitary conditions. Employees were instructed to dry sweeping of floors and shelves without the appropriate PPE.

Every enclosed workplace shall be so constructed, equipped, and maintained, so far as reasonably practicable, as to prevent the entrance or harborage of rodents, insects, and other vermin. A continuing and effective extermination program shall be instituted where their presence is detected. Location: To include but not limited to, pet area, bird seed area, clothing and food back room, carpet area, shelving with food, employee break room. On or about 1/11/19 the building was not adequately maintained to prevent the harborage of vermin. Vermin feces and nesting material was visible in employee work areas such as on shaving, retail products, and the floor.
