29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Martin & Sons Excavating, Inc. at 6435 Crossroads Blvd., Windsor, CO 80550: On and before February 15, 2019, the employer did not ensure daily inspections of excavations, the adjacent areas, and protective systems were made by a competent person for evidence of possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Employees were installing a precast cement box into a trench using a Cat 320E trackhoe and wire rope slings. Employees were standing in-between the precast box and the trench walls, when the load shifted, and pinned an employee between the precast box and the trench walls. An inspection was not conducted by the competent person to ensure that employees were not placed in a hazardous condition of being caught in-between the precast box and the trench walls.
