29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a fork truck:    On or about March 5, 2019, the employer engaged in the operation of an all-terrain forklift without ensuring the operator's competency to safely operate the equipment, as demonstrated by the successful completion of forklift training and evaluation. 29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    On or about March 5, 2016, an employee working from the fifth section of a metal frame scaffold was not protected from a fall by a complete guardrail, exposing the employee to a fall of approximately 30 feet.    The Fox Valley Masonry Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(i), which was contained in OSHA inspection number1344185, citation number 1, item number 1 and was affirmed as a final order on October 31, 2018, with respect to a workplace located at 724 N. York Rd.  Hinsdale, IL 60521.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
