29 CFR 1910.1200(e)(1): Employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) of 1910.1200 for labels and other forms of warning, safety data sheets, and employee information and training will be met:  (a) Zivo, Inc. DBA Zelios at 3000 Airport Drive Suite 405/406, Erie CO 80516: On and preceding 3/18/2019, the employer did not develop, implement or maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of 29 CFR 1910.1200 for labels and other forms of warning, safety data sheets, and employee information and training will be met. Employees worked in a hemp extraction and refining facility that used carbon dioxide for extraction and ethanol for refining.  This condition exposed employees to chemical hazards associated with the use of chemicals such as, but not limited to, carbon dioxide and ethanol.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:   (a) Zivo, Inc. DBA Zelios at 3000 Airport Drive Suite 405/406, Erie CO 80516: On and preceding 3/18/2019, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. Employees used ethanol for refining. The recovered ethanol from the rotary evaporators was not labeled or marked indicating the presence and hazards of the chemicals.  This condition exposed employees to a chemical hazard.  (b) Zelios at 3000 Airport Drive Suite 405/406, Erie CO 80516: On and preceding 3/18/2019, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. Employees used isopropyl alcohol for cleaning. A container of isopropyl in the flammable liquids cabinet was not labeled or marked indicating the presence and hazards of the chemicals. DBA Zelios at 3000 Airport Drive Suite 405/406, Erie CO 80516: On and preceding 3/18/2019, the employer did not ensure that no more than 60 gallons of a Category 2 flammable liquid was stored in a storage cabinet. Employees used ethanol in the refining process. A 55 gallon drum of ethanol and two five gallon containers of isopropyl alcohol were located in a storage cabinet.  This condition exposed employees to a fire and explosion hazard.

Employees stored their respirators in the refining area in an open container.  This condition potentially exposed the employees to respiratory hazards.
