29 CFR 1926.451(e)(8): Direct access to or from another surface shall not be used when the scaffold is more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface:    (a)Horst Acoustical Co. @ 2300 Elgin Street, Rapid City, SD 57701: On or about and at times prior to March 21, 2019, the exposing employer did not ensure each employee was provided adequate direct access from scaffolding to a roof.  Employees were using a scaffold plank located on the second level of a mobile fabricated frame scaffolding system to gain access to a roof, which was located approximately 30 inches in height from the scaffold plank. Employees were using the scaffolding to access the roof for steel stud installation without the use of fall protection system. The condition exposed employees to a fall hazard of approximately 10-foot 6 inches.

29 CFR 1926.451(e)(6)(vi): 29 CFR 1926.451(e)(6)(vi): Integral prefabricated scaffold access frames did not have a maximum spacing between rungs of 16 3/4 inches (43 cm):    (a)Horst Acoustical Co. @ 2300 Elgin Street, Rapid City, SD 57701: On or about and at times prior to March 21, 2019, the exposing employer did not ensure each employee was provided sufficient access due to inadequate ladder rung spacing on end-frames of a fabricated frame scaffolding system. The ladder rungs on the end-frames were measured at approximately 22.25 inches in vertical distance from the top of each rung. Employees were climbing the integrated ladder rungs on the end-frames to gain access to the roof. The condition exposed employees to a fall hazard while climbing the scaffolding to gain access to the roof.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:       (a)Horst Acoustical Co. @ 2300 Elgin Street, Rapid City, SD 57701: On or about and at times prior to March 21, 2019, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet or more above a lower level was protected from falling by the use of a guardrail system, a safety net system or personal fall arrest system. Employees were engaged in the installation of steel studs on the roof while exposed to fall hazards. The condition exposed employees to a fall hazard of approximately 10 feet and 6 inches to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:       (a)Horst Acoustical Co. @ 2300 Elgin Street, Rapid City, SD 57701: On or about and at times prior to March 21, 2019, the exposing employer did not ensure that each employee engaged in erecting steel studs on the roof of a commerical building, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The condition exposed employees to the hazard of falling from an elevation of approximately 10 foot 6 inches.
