29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a) Korwell Energy, LLC at 21970 County Road, Hudson, CO: On and around March 11, 2019, the employer had obtained a written Hazard Communication Program but had not developed, implemented, and maintained it at the workplace as a site specific written hazard communication program. Employees are potentially exposed to hazardous chemicals, including but not limited to the following:     1) Steel Spec Structural Steel Primer Brownish Red  2) Industrial Enamel  3) Xylenes

29 CFR 1910.1200(f)(6): The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5):    (a) Korwell Energy, LLC at 21970 County Road, Hudson, CO: On and around March 28, 2019, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemicals contained within. Employees were potentially exposed to unlabeled hazardous chemicals in and around the blue conex container, including but not limited to unleaded gasoline, diesel exhaust fluid, and an unknown chemical in a bottle of Powerade.

The safety data sheets were stored in a locked office and were not readily accessible to employees. This condition potential exposed employees to chemical hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) Korwell Energy, LLC at 21970 County Road, Hudson, CO: On and around March 28, 2019, the employer did not ensure that employees were initially provided Hazard Communication training before being potentially exposed to or working with hazardous chemicals. A single training session had been conducted but did not include all exposed employees. This condition potentially exposed the employees to chemical hazards.

29 CFR 1910.305(g)(2)(iii): Flexible cords were not connected to devices and fittings so that tension would not be transmitted to joints or terminal screws:  (a) Korwell Energy, LLC at 21970 County Road, Hudson, CO: On and around March 28, 2019, the outer insulation of an electrical power cord to a Lincoln Electric 350MP wire welder in the north west corner of the Main Building had become detached from the plug. The interior insulation of the conductors in the cord had been damaged and showed bare copper. This condition potentially exposed an employee to shock and electrocution hazards.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  (a) Korwell Energy, LLC at 21970 County Road, Hudson, CO: On and around March 18, 2019, the employer did not evaluate the respiratory hazards in the workplace in that employees, working in the Main Shop area, were exposed to hazardous chemicals from spray operations on vessels in the Main Shop area but the employees were not monitored or evaluated for exposure. This condition potentially exposed employees to a respiratory hazards from paints, primers, and paint thinners including but not limited to Steel Spec Structural Steel Primer, Industrial Enamel, and xylenes.  (b) Korwell Energy, LLC at 21970 County Road, Hudson, CO: On and around April 4, 2019, the employer did not evaluate the respiratory hazards in the workplace in that an employee, welding on mild steel, was not monitored or evaluated for exposure. This condition potentially exposed an employee to respiratory hazards from welding, including but not limited to iron oxide, manganese fumes and copper fumes.
