29 CFR 1926.251(a)(2)(i): The employer failed to ensure rigging equipment had permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load:  a) Expercon, LLC at the worksite located at 53 Main Street Toledo, Ohio 43605; On or about April 2, 2019 the employer did not ensure the rigging equipment used on the Hitachi excavator (Model: EX200LC-5 MFG. No.:AMD300043) was inspected by a qualified engineer prior to use to ensure safe working limits. Employees were exposed to struck by hazards in that the rigging attachment, wrecking ball, cable wire, and a G178 Mixer tire, attached to the Hitachi excavator was not inspected for safe load limits.

29 CFR 1926.251(c)(5)(i): The U section of U-bolt wire rope clip(s) used to form eyes was not in contact with the dead end of the rope:  a) Expercon, LLC at the worksite located at 53 Main Street Toledo, Ohio 43605; On or about April 2, 2019 the employer did not ensure the U-section of a U-bolt wire rope clip was in contact with the dead end of the wire rope. Employees were exposed to stuck by hazards in that a G178 Mixer tire was secured to a wire rope as part of a demolition attachment to the Hitachi excavator (Model: EX200LC-5 MFG. No.:AMD300043) in a manner in which the dead end of the wire rope was in contact with the U-Bolt Saddle.

29 CFR 1926.859(d): The ball was not attached to the loadline with a swivel- type connection to prevent twisting of the loadline:    a) Expercon, LLC at the worksite located at 53 Main Street Toledo, Ohio 43605; On or about April 2, 2019 the employer did not ensure the wrecking ball was attached to the wire rope load line with a swivel-type connection on the Hitachi excavator (Model: EX200LC-5 MFG. No.:AMD300043). Employees were exposed to struck by hazards in that the twisting of the load line could lead to failure.
