29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Jobsite: On April 3, 2019 and at times prior thereto a ladder or other safe means of egress was not available in a 4.5  foot deep trench.  Employee(s) did not recognize or acknowledge the hazard of not having a safe way out of the trench or take action to correct the hazard.   b) Jobsite: On April 3, 2019 and at times prior thereto material excavated from the trench was placed at or near the edge of the trench wall.  Employee(s) did not recognize or acknowledge the hazard of having the additional weight on the trench wall and excavated material that could roll into the trench, or take action to correct the hazard.      c) Jobsite: On April 3, 2019 and at times prior thereto the competent person on site used benching on Type C soil, as a means of cave-in protection.  Employee(s) did not recognize or acknowledge the most protective means for the soil type and conditions, or take action to correct the hazard.     Note) Certification of corrective actions are required for these items.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) Jobsite: On April 3, 2019 and at times prior thereto a safe means of egress was not in place while an employee installed a water line in a 4.5 foot deep trench that was approximately 120 feet long.  The employee used the benched soil to get out of the trench.       Note) Certification of corrective action is required for this item.
