29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:    (a) Excellent Construction, LLC at 1650 Lakeview Terrace, Frisco, CO: On and before April 24, 2019, the exposing employer failed to ensure that employees used personal fall arrest or personal fall restraint systems with a lanyard attached to the boom or basket, when operating and working from the baskets two Genie S-65 aerial lifts at a residential condominium. Employees were being elevated to and from second and third story balconies for siding work and were conducting siding work from the baskets of two Genie S-65 aerial lifts but were not using personal fall arrest or personal fall restraint systems with lanyard attached to the boom or basket. This condition exposed employees to a fall hazards of approximately 28 feet in height.    Abatement Note: A personal fall arrest system is recommended with lanyard attached to the boom or basket when working from an aerial lift. As of January 1, 1998, Subpart M of the 29 CFR 1926 part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Excellent Construction, LLC at 1650 Lakeview Terrace, Frisco, CO: On and before April 24, 2019, the exposing employer did not ensure that employees were protected from injury, in that employees were not effectively trained to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. Employees were being elevated to and from second and third story balconies for siding work and were conducting siding work from the baskets of two Genie S-65 aerial lifts but had not been provided a training program to recognize the hazards of falling and the procedures for wearing and tying off personal fall arrest or personal fall restraint systems to the basket or boom of the aerial lift. This condition potentially exposed employees to a fall hazard of approximately 28 feet.    Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: 1) The nature of fall hazards in the work area; 2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  4) The role of each employee in the safety monitoring system when this system is used; 5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and 7) The role of employees in fall protection plans; 8) The standards contained in this subpart.
