29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: (a) New residential construction located on Lot #14, Front side at cut bench: On or about 05/07/2019, and at times prior, the employer exposed employees to silica exposure while cutting Hardie Plank trim and siding, in that the DeWalt (Model - DWE575) 7-1/4-inch circular saw was not equipped with the HEPA Vacuum attachment while cutting fiber cement products.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: (a) New residential construction located on Lot #14, Front side at cut bench: On or about 05/07/2019, and at times prior, employees were permitted to perform outdoor fiber cement board cutting using a DeWalt circular saw without vacuum attachment as other employees were permitted to walk and work in close proximity to the cutting area.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: (a) New residential construction located on Lot #14, Front lower roof: On or about 05/07/2019, and at times prior, the employer exposed employees to fall hazards of 22-feet, 6-inches to the lower level, in that a fall protection system was not provided to employees installing fascia boards from a ladder jack scaffold system. Blas Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1234349, citation number 1, item number 2(a) and was affirmed as a final order on 07/17/2017, with respect to a workplace located at 2475 Webb Road, Milton, GA 30004.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located on Lot #14, Front lower roof: On or about 05/07/2019, and at times prior, the employer exposed employees to fall hazards of 13-feet, 2-inches to the lower level, in that a fall protection system was not provided to an employee using the 4/12 pitched roof as a walking/working surface. Blas Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1234349, citation number 1, item number 2(b) and was affirmed as a final order on 07/17/2017, with respect to a workplace located at 2475 Webb Road, Milton, GA 30004.
