29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not provided with a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material: On or about May 21, 2019 employees for Townley Construction Company were exposed to struck by hazards by motor vehicle traffic, while performing sewer line installation tasks alongside Highway 9 South in Dawsonville, Georgia when the employer failed to ensure that each employee was wearing proper warning vest or highly reflective clothing. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about May 21, 2019 at the worksite located on 1470 Highway 9 South in Dawsonville, Georgia an employee was exposed to cave in hazards, while occupying an unprotected trench to attach new sewer pipe, when the employer failed to provide adequate protection for the employee within the trench area. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about May 21, 2019 a the worksite located at 1470 Highway 9 south in Dawsonville, Georgia, employees were exposed to struck by hazards when the employer failed to ensure that excavated material was placed at least two feet away from the edge of the trench. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. Townley Construction Company, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 1006489, citation number 1, item number 2 and was affirmed as a final order on January 12,2015, with respect to a workplace located at Across from 6903 Hwy. 53 E (Dollar Store), Dawsonville, Georgia .
