29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Trench: On or about 01/23/2024, the employer exposed employees to struck-by hazards while searching for pipe lines inside of the 33-foot long X 5-foot wide X 5-foot, 6-inch to 6-foot, 4-inch deep, sheer cut, unprotected trench,  in that protective headwear use was not enforced.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) Trench: On or about 01/23/2024, the employer exposed employees to struck-by hazards during access and egress of the 33-foot long X 5-foot wide X 5-foot, 6-inch to 6-foot, 4-inch deep sheer cut, unprotected trench,  in that there was no ladder in use and the used access/egress point was blocked by the excavator and did not meet the requirements for a ramp.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).   a) Trench: On or about 01/23/2024, the employer exposed employees searching for the buried lines to struck-by and engulfment hazards while inside of the 5-foot, 6-inch to 6-foot, 4-inch deep, sheer cut, unprotected trench,  in that the cave-in protection that was available onsite was not in use.  Townley Construction Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1405900, citation number 1, item number 2 and was affirmed as a final order on 11/20/2019, with respect to a workplace located at Hwy 9 South Dawsonville, GA 30534.
