NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section: Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsoleted; or (3) inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retrained the requisite understanding or skill:  a) Worksite: Employees constructing a leading edge approximately 20 ft. above lower levels were not using adequate fall protection; on or about 6/7/19. 29 CFR 1926.101(a): Ear protective devices were not provided and/or were not used when it was not feasible to reduce noise levels or duration of exposures to those specified in Table D-2, Permissible Noise Exposure, in 29 CFR 1926.52:  (a) On or about June 07, 2019 -Job site 41-62 Bowne Street, Flushing NY 11354   Employees were observed operating a Jackhammer drilling through concrete without hearing protection.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
