29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, was not provided to assist employees in mounting and dismounting the ladder.  a)     Robert Wagner Roofing on or about June 18, 2019, at the address of 3433 Darlington Rd Toledo, OH: The employer did not ensure the side rails of the 24 feet aluminum extension ladder was extended at least three feet above the landing surface. Three employees were exposed to falls of up to 20 ft. while using the ladder to access the west side of the second level and the steep-sloped roof.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other for which they were designed.  a)  Robert Wagner Roofing on or about June 18, 2019, at the address of 3433 Darlington Rd, OH: The employer failed to ensure an 8 ft. A-framed stepladder was opened during use.  The ladder was closed and leaning against the structure while employees used the ladder to access the roof level. Employees were exposed to fall hazards due to the improper use and placement of this ladder.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system nor are employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) Robert Wagner Roofing on or about June 18, 2019, at the address of 3433 Darlington Rd Toledo, OH: The employer did not ensure employees were protected from falls while performing roofing activities atop a steep sloped residential type structure. Employees removing old roofing material from atop the structure were exposed to falls up to 20 ft. to the ground below.    Robert Wagner Roofing was previously cited for a violation of an equivalent Occupational Safety and Health standard 1926.501(b)(13) which was contained in OSHA inspection number 1151233, citation number 1, item number 1 and was affirmed as a final order on June 15, 2016, with respect to a workplace located at 2939 Gunkel Toledo, OH.    Robert Wagner Roofing was previously cited for a violation of an equivalent Occupational Safety and Health standard 1926.501(b)(11) which was contained in OSHA inspection number 1082161, citation number 1, item number 1 and was affirmed as a final order on August 4, 2015, with respect to a workplace located at 7223. Maumee Western Rd., Maumee, OH.
