29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Robert Wagner Roofing LLC:  The employer does not ensure employees are protected from falls while performing roofing work on residential type structures.  Employees are exposed to falls of up to 21 feet 5 inches to the ground below.  This violation was most recently observed on or about September 9, 2019, at the address of 320 W. Maple St, Liberty Center, Ohio.

29 CFR 1926.20(b)(1): The employer to did not initiate and maintain such programs as may be necessary to comply with this part.  a. Robert Wagner Roofing LLC:  The employer does not have a plan or program to identify job site hazards which assist employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.  This violation was most recently observed on or about September 9, 2019, at the address of 320 W. Maple St., Liberty Center, Ohio.  Wagner Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(1), which was contained in OSHA inspection number 1078748, citation number 1, item number 1a and was affirmed as a final order on August 13, 2015, with respect to a workplace located at 445 Alexis Rd, Toledo, Ohio.
