29 CFR 1910.178(l)(2)(ii): At this establishment, the employer had not conducted the practical training and the workplace evaluation of employees as required under this standard. On or about July 1, 2019, the employer failed to ensure that employees who operate various powered industrial vehicles, to include but not limited to the Yale, Crown and Jungheinrick, were trained as competent to operate in that they had not completed classroom training which included an instructional video and written test and a hands on operation evaluation of their learned skills.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about July 1, 2019, the employer failed to ensure that a powered industrial vehicle (Jungheinrick) that was found to have a burned out head light was removed from service or evaluated to determine if it was safe to operate. The employer does not have a process in place to check each powered industrial vehicle prior to operation to ensure it is in good functional order.
