29 CFR  1910.178(p)(1):  Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition.  On or about 10/26/2020, the employer failed to ensure that a powered pallet jack (Raymond, red,  #13) was removed from service after being informed the equipment was losing power and making sudden stops.  The Raymond powered pallet jack was plugged in, charging for use, and did not have any signage indicating for it to not be used by employees.  The powered pallet jack had not been inspected or restored to ensure a safe operating condition.   The Sidari's Italian Foods was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(p)(1), which was contained in OSHA inspection number 1413182, citation number 1, item number 2, and was affirmed as a final order on 11/20/2019, with respect to a workplace located at 3820 Lakeside Ave. Cleveland, Ohio 44114.

29 CFR  1910.22(d)(1):  The employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition:  On or about 10/26/2020, the employer failed to ensure that walking-working surfaces were maintained in a safe condition. The access area between the two sides of the warehouse had an uneven, cracked, and crumbling concrete surface. This highly traveled working surface presented a tripping hazard to employees as well as hazardous condition for operating powered industrial vehicles.
