29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: a) 26162 Bay Boulevard, Millsboro, Delaware - On or about July 5, 2019, the employer failed to ensure that the entire work platform being used to elevate individuals on a JLG SkyTrak 8042 Telehandler, was secured to the forks. Employees were working from an unapproved and unsecured work platform constructed of stacked plywood while engaged in framing activities at heights of approximately thirty (30) feet above grade.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) 26162 Bay Boulevard, Millsboro, Delaware - On or about July 5, 2019, the employer failed to ensure that employees working from an unapproved and unsecured work platform on a JLG 8042 SkyTrak Telehandler were protected from fall hazards. Employees engaged in framing activities approximately thirty (30) feet above grade, were working from a temporary work platform constructed of a stack of plywood resting on the forks of the telehandler without any means of fall protection.
