OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to tipping and crushing hazards while operating a powered industrial truck (forklift) without a restraint system.  a. On or about 7/10/2019, at Water Spirit Freight Services VI, Inc. marine terminal, at Pier 10 of San Juan Bay Harbor, the employer allowed the operators of a Model DP40K Caterpillar diesel powered industrial truck (forklift), to use such equipment, even though the seat belts were missing or removed against manufacturer's specifications. No other restraint system was available as an alternative for the missing or removed seat belts. Employees were exposed to tipping and/or crushing hazards.  NOTE:  Certification of abatement is not required for this citation item since it was submitted prior to citation issuance.

29 CFR 1910.305(b)(2)(i): An outlet box did not have a cover, faceplate, or fixture canopy.  a. On or about 07/10/2019, at the office trailer kitchenette, eleven inches above the counter top, employees were exposed to electrical hazards from a live uncovered electrical branch circuit outlet box. There were two appliances plugged into the outlet.    Note: Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c) and (d), respectively.

29 CFR 1917.43(c)(5): Powered industrial truck was not maintained in safe working order and its safety devices were removed or made inoperative.  a. On or about 7/10/2019, at Pier 10 of San Juan Bay Harbor, the employer did not ensure that the Caterpillar diesel powered industrial truck, Model DP40K, was maintained in a safe working condition, as evidenced by the worn out and cracked tires. Employees were exposed to tipping and/or crushing hazards.  b. On or about 7/10/2019, at Pier 10 of San Juan Bay Harbor, the employer did not ensure that the Caterpillar diesel powered industrial truck, Model DP40K, was maintained in a safe working condition, as evidenced by the exposed electrical wires from the front lights. Employees were exposed to electrical shock and/or burns.  c. On or about 7/10/2019, at Pier 10 of San Juan Bay Harbor, the employer did not ensure that the safety devices of the Caterpillar diesel powered industrial truck, Model DP40K, were not removed or made inoperative, as evidenced by  the broken right reverse signal light. Employees were exposed to struck by and/or caught in between hazards.   d.  On or about 7/10/2019, at Pier 10 of San Juan Bay Harbor, the employer did not ensure that the safety devices of the Caterpillar diesel powered industrial truck, Model DP40K, were not removed or made inoperative, as evidenced by the disconnected and broken safety warning or strobe light. Employees were exposed to struck by and/or caught in between hazards.  NOTE: Certification and documentation of abatement must be submitted for this citation item as required by CFR 1903.19(c).
