29 CFR 1926.20(b)(2):  The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)Kuechenmeister Construction at 1222 22nd Avenue, Brookings, SD 57006: On or about and at times prior to July 22, 2019, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    (a)Kuechenmeister Construction at 1222 22nd Avenue, Brookings, SD 57006: On or about and at times prior to July 22, 2019, the exposing employer did not ensure that employees were protected from serious injury while using of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the rough terrain forklift manufacturer. The employer utilized the forklift platform in the construction of a commercial project. The platform was not specifically approved by the forklift manufacturer nor did it meet ASME/ITSDF B56.6-2011 requirements. The platform exceeded criteria for the overall length and did not have a data plate identifying maximum working load including personnel and equipment. This condition exposed employees to a fall hazard of approximately 13 feet and crushing hazards related to the platform separating from the mast.     Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ITSDF B56.6-2011, American Society of Mechanical Engineers/Industrial Truck Standards Development Foundation, "Safety Standards for Rough Terrain Forklift Trucks",  Section 8.24.1, Platforms for Elevating Personnel, in the following areas: (1)Paragraph (b) which states, "floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a length greater than the overall width of the truck measured across the load bearing tires plus 10 in. (250 mm) on either side. (2)Paragraph (f) which states, "information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform." 29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:    (a)Kuechenmeister Construction at 1222 22nd Avenue, Brookings, SD 57006: On or about and at times prior to July 22, 2019, the exposing employer did not ensure that employees were protected from falls while working on a temporary platform used in conjunction with a rough terrain forklift. Employees were working on the elevated work platform attached to the Ingersoll Rand All-Terrain Forklift Model VR-60 B without guardrails erected around the exterior of the platform. This condition exposed employees to a fall hazard of approximately 13 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)Kuechenmeister Construction at 1222 22nd Avenue, Brookings, SD 57006: On or about and at times prior to July 22, 2019, the exposing employer did not ensure that employees were properly trained to recognize the hazards associated with scaffolding systems. Employees were working from a platform that was attached to the Ingersoll Rand All-Terrain Forklift Model VR-60 B that was not equipped with guardrails around the exterior of the platform. This condition exposed employees to a fall hazard of approximately 13 feet.
