29 CFR 1910.178(l)(1)(i):     The employer had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l) [Reference 29 CFR 1926.602(d) for construction]:      a)  15 Chetwynd Terrace, At the Chetwynd Water Tower, Livingston, NJ and at the Corporate Offices at 177 Elmwood Ave. Long Branch, NJ.    The operator of the rough terrain forklift and employees in the area of the fork lift and working on the scaffold where the lift was operating, were in danger of injury as the operator of the lift had not completed training and evaluation by his employer on forklift operations.                                Violation occurred on or about 07/13/2019..

29 CFR 1926.451(f)(3):     Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    a)  15 Chetwynd Terrace, At the Chetwynd Water Tower, Livingston, NJ.    Employees were exposed to falls of up to 156 feet to the ground below from the fabricated frame scaffold which encircled the water tower as the competent person did not inspect or take action to ensure such a tall scaffold, which had been damaged at its base at one time, had been approved for worker use by a registered professional engineer.                                     Violation observed on or about 08/02/2019.

Employees were exposed to injury from falls or hoist failure as 2 workers rode the basket of the Maxial Track Hoist from the upper level of scaffolding to the ground and the hoist is only to be used for materials. Employees were exposed to falls of up to 156 feet to the ground below from the fabricated frame scaffold which encircled the water tower as the scaffold could potentially exhibit structural problems given that the scaffold was only approved by a P.E. for containment use and not for workers using it to blast and paint the water tower.                                    Violation observed on or about 08/02/2019.
