29 CFR 1926.62(l)(1)(i): 29 CFR 1926.62(l)(1)(i):  The employer did not include lead in the program established to comply with the Hazard Communication Standard (HCS) (29 CFR 1910.1200),  ensure that each employee had access to labels on containers of lead and safety data sheets,  was trained in accordance with the provisions of the Hazard Communication standard and 29 CFR 1926.62(l), and ensure that all the following hazards were addressed: Reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects:  a) Thurston Road, Rochester, NY - On or about and prior to 7/30/19, employees working in an area where paint chips contained between 0.0409%-0.5506% lead. This work was all performed dry without the use of any water or devices equipped with an integrated water delivery system that continuously feeds water to the device. 29 CFR 1926.1153(f)(1):  The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods that minimize the likelihood of exposure were feasible.  a) Thurston Road, Rochester, NY - On or about, and prior to 7/23/19, the employer allowed dry sweeping where such activity could contribute to employee exposure to respirable crystalline silica.  Employees dry swept and shoveled debris containing respirable crystalline silica from the floors.  Bulk samples taken from the area revealed debris taken from the area contained 3%-10% crystalline silica.  ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan that contained at least the following elements:     (i) A description of the tasks in the workplace that involve exposure to respirable crystalline silica;     (ii) A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task;     (iii) A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica; and     (iv) A description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors.  a) Thurston Road, Rochester, NY - On or about, and prior to 7/23/19, the employer did not establish and implement a written exposure control plan which contained the elements required in 1926.1153(g)(1)(I) through (iv).
