Located at 238 Faulknner Drive, Lot #173, Lithopolis, Ohio: On or about August 16, 2019, the employer failed to ensure that an employee used appropriate eye protection while he installed framing lumber with the pneumatic nail gun. The employee operated the pneumatic nail gun without being protected from struck by hazards to his eyes.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. Located at 238 Faulknner Drive, Lot #173, Lithopolis, Ohio: On or about August 16, 2019, the employer failed to adequately enforce his safety and health program to ensure hazard detection, and correction while employees installed framing lumber at the second floor level of the new build residential home. One employee was unprotected from falls and struck by hazards to his eyes respectively. The employee was exposed to a fall distance of 12 feet to the ground level and eye injuries due to the lack of using eye protection. Chris Gaskill was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1330903, citation number 1, item number 1a and was affirmed as a final order on September 20, 2018, with respect to a workplace located at 7231 Monarch Street, Canal Winchester, Ohio.

Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located at 238 Faulknner Drive, Lot #173, Lithopolis, Ohio: On or about August 16, 2019, the employer failed to ensure that an employee who worked on the second floor level of a new build residential home was protected from falling off the second floor level. The employee was exposed to a fall hazard of 12 feet without using adequate fall protection.
