29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a. Located at 238 Faulknner Drive, Lot #173, Lithopolis, Ohio: On or about August 16, 2019, the employer failed to ensure that an employee used appropriate eye protection while he installed framing lumber with the pneumatic nail gun.  The employee operated the pneumatic nail gun without being protected from struck by hazards to his eyes.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a. Located at 238 Faulknner Drive, Lot #173, Lithopolis, Ohio: On or about August 16, 2019, the employer failed to adequately enforce his safety and health program to ensure hazard detection, and correction while employees installed framing lumber at the second floor level of the new build residential home.  One employee was unprotected from falls and struck by hazards to his eyes respectively.  The employee was exposed to a fall distance of 12 feet to the ground level and eye injuries due to the lack of using eye protection.    Chris Gaskill was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1330903, citation number 1, item number 1a and was affirmed as a final order on September 20, 2018, with respect to a workplace located at 7231 Monarch Street, Canal Winchester, Ohio.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    a. Located at 238 Faulknner Drive, Lot #173, Lithopolis, Ohio: On or about August 16, 2019, the employer failed to ensure that an employee who worked on the second floor level of a new build residential home was protected from falling off the second floor level. The employee was exposed to a fall hazard of 12 feet without using adequate fall protection.
