OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while working from an elevated platform supported on the forks of a rough terrain forklift which created an unstable tipping hazard.    a) Job Site - Employees were observed working from an elevated platform supported on the forks of an Ingersoll-Rand VR-843 rough terrain forklift (serial number 173528), approximately 20 feet above ground.  The platform width was greater than 10 inches beyond the wheel base of the machine on each side, on or about 09/16/19.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The platform measured approximately 20' long x 5' wide and had not been designed by a qualified person, on or about 09/16/19.    Abatement certification required within 10 days after abatement date. 29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use:  a) Job Site - Employees were observed worked from a job-made elevated platform supported on the forks of an Ingersoll-Rand VR-843 rough terrain forklift, approximately 20 feet above ground, on or about 09/16/19.  Ingersoll-Rand does not permit the use of work platforms for elevating personnel on VR-843 models.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The operator had dismounted the forklift leaving no one at the controls.    Abatement certification required within 10 days after abatement date.
