OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while working from an elevated platform supported on the forks of a rough terrain forklift which created an unstable tipping hazard. a) Job Site - Employees were observed working from an elevated platform supported on the forks of an Ingersoll-Rand VR-843 rough terrain forklift (serial number 173528), approximately 20 feet above ground. The platform width was greater than 10 inches beyond the wheel base of the machine on each side, on or about 09/16/19. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
