29 CFR 1926.1153(g)(1)(iv): The exposure control plan did not contain a  description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors:    (a) On or about August 19, 2019, and at times prior to, employees on the jobsite were working in an area where a visible dust cloud was created by a subcontractor dry grinding on sandstone and did not have written procedures in the form of an exposure control plan to restrict access to the hazardous area.     Note: Abatement certification AND documentation ARE required for this item.

29 CFR 1926.1153(i)(2)(i)(C): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used:  (a) On or about August 19, 2019 and at times prior to, employees did not demonstrate knowledge and/or understanding of the hazards posed by the dust cloud (created by the subcontractor) by continuing to work in the immediate area of exposure.  Note: Abatement certification AND documentation ARE required for this item.
