29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)Mg Landscaping and Preservation LLC, at 704 West 57th Street, Sioux Falls, SD 57108:  On or about and at times prior to October 15, 2019, the employer did not ensure that employees were protected from falls by a fall protection system while conducting roofing activities on a residential property.  This condition exposed employees to fall hazards of 10 to 35 feet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Mg Landscaping and Preservation LLC at 704 West 57th Street, Sioux Falls, SD 57108:  On or about and at times prior to October 15, 2019 the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Mg Landscaping and Preservation LLC at 704 West 57th Street, Sioux Falls, SD 57108:  On or about and at times prior to October 15, 2019 the employer did not ensure that each employee was protected from falls from heights in that employees were utilizing ladders to gain access to the roof that was not extended at least three feet above the upper landing surface.

This condition exposed employees to fall hazards of over 10 feet.
